ECRE paper on Defending Refugees' Access to Protection in Europe

European Council on Refugees and Exiles (ECRE) released a new paper “Defending Refugees' Access to Protection in Europe”. The paper aims to highlight the barriers that people in need of

protection face in trying to reach EU territory and how Member States' border control activities risk breaching their obligations under international and regional refugee and human rights instruments as well as under Community law.

The paper explores how surveillance and interception measures have been expanded away from the EU external borders and emphasises why this sort of externalisation does not free Member States from their international protection responsibilities towards asylum seekers. It examines the numerous control measures of European countries and the European Border Management Agency (FRONTEX) at land, air and sea borders to prevent irregular migration and makes many recommendations to the EU, including FRONTEX and the European Commission as well as Member States, on how they could develop migration controls that are more sensitive to protection concerns.

The following are some of the key recommendations included in the paper:

- The allocation of the External Borders Fund should prioritise activities aimed at developing protection-sensitive border controls.

- FRONTEX should ensure that protection and human rights safeguards are an integral part of its work e.g. by concluding working arrangements with UNHCR and relevant NGOs.

- The legal basis for FRONTEX operations should be clarified. In any case, these operations should not be implemented outside the EU external borders.

- Asylum Expert Teams should urgently be formed and made operational. They could play a role in identifying and monitoring asylum seekers at the borders, and act as a vehicle to bring in the protection expertise that FRONTEX and RABITS lack.

- Member States should abide by their asylum and human rights' obligations wherever they exercise migration controls, and ensure that asylum seekers are granted access to a fair and efficient asylum procedure.

- Pre-frontier controls should not prevent the departure of persons in need of protection from the countries in which they face a risk of persecution. This requires that visa restrictions are lifted in

the event of significant humanitarian crises, and that carriers are not sanctioned for transporting migrants that are subsequently admitted to the asylum procedure.

- Immigration Liaison Officers (ILOs) and Airport Liaison Officers (ALOs) should play a positive role in facilitating entry into the EU of people who wish to apply for protection.

- Any country involved in interception at sea or performing a rescue operation should be responsible for ensuring the safety of the people intercepted or rescued and the fulfillment of human rights and protection requirements towards them.

- The EU must share the burden of rescue and refugee protection e.g. by envisaging mechanisms that allow the relocation of refugees after their status has been determined.

- UNHCR and NGOs should be increasingly involved in monitoring the implementation of Member States' border controls and readmission agreements with third countries.

- Member States are encouraged to set up new mechanisms, such as Protected Entry Procedures, to ensure legal and safe access to the EU of persons in need of protection.
